PART A — ENGLISH TEXT
In these Terms and Conditions (the “Terms”):
(a) “ACI Semiconductor”, “we”, “us” and “our” mean ACI Semiconductor Limited, a company incorporated in Bangladesh, having its office at Aristo Tower (Level 3), 239 Bir Uttam Mir Shawkat Sarak (Tejgaon–Gulshan Link Road), Dhaka 1208, Bangladesh.
(b) “ARTIS” means the Advanced Research & Training Institute for Semiconductor, the training institute operated by ACI Semiconductor Limited. ARTIS is a brand and operating unit of ACI Semiconductor Limited and is not a separate legal entity; ACI Semiconductor Limited is the contracting party under these Terms.
(c) “Website” means www.acisemi.com, including all of its pages and sub-domains.
(d) “Programme” means any course, workshop, seminar, industrial attachment, or other training activity that we offer.
(e) “Trainee” means a person whose enrolment in a Programme has been confirmed by us.
(f) “You” means any visitor to the Website, any person who submits an enquiry or application, and any Trainee.
(g) “Facility” means our training premises, classrooms, laboratories, workstations, equipment and networks.
(h) “Personal data” has the meaning given in the Personal Data Protection Act, 2026 (Act No. 63 of 2026).
(a) By using the Website, by submitting an enquiry, expression of interest or application, or by enrolling in a Programme, you confirm that you have read, understood and accepted these Terms.
(b) If you do not accept these Terms, please do not use the Website or our services.
(a) Our Programmes and paid services are offered only to persons aged 18 years or above. We do not knowingly enrol or provide services to minors, and we do not knowingly collect the personal data of minors.
(b) You confirm that the information you provide to us is true, complete and current, and that you will inform us promptly if it changes.
(c) Certain Programmes state assumed knowledge or prerequisites. We may verify these, and we may decline, defer or redirect an application on academic, capacity or scheduling grounds.
(a) We provide semiconductor and VLSI training, supervised laboratory access, mentoring, assessment, certification and career support services.
(b) Career counselling, mentor connect, industrial attachment and placement support are support services only. We do not guarantee employment, an internship, a placement, an interview, a particular salary, or any other specific outcome.
(c) Any figures published on the Website or in our materials concerning past placement or completion outcomes describe previous cohorts. They are not a representation or promise about your own result.
(d) Programme content, tools, tool versions, instructors, delivery mode and schedules are kept aligned with industry practice and may be updated from time to time.
You agree that you will not:
– use the Website for any unlawful, fraudulent or misleading purpose;
– attempt to gain unauthorised access to the Website, our systems, or any account;
– introduce malicious code, or interfere with or disrupt the operation of the Website;
– use automated means to scrape, harvest or extract content or contact information;
– post or transmit unlawful, defamatory, offensive, obscene or infringing material through any form or feature we provide.
Certain of these acts may also constitute offences under the Cyber Protection Act, 2026 and other applicable law.
(a) You may submit an enquiry or expression of interest through the Website. Doing so does not create a contract, does not constitute an application for admission, and does not reserve a seat in any Programme.
(b) We will use the contact details you provide to respond and, where you have indicated interest, to inform you about relevant Programmes. You may ask us at any time to stop contacting you.
(a) Enrolment is confirmed only when we issue a written confirmation of enrolment and the applicable fee is received in accordance with that confirmation.
(b) Seats in each batch are limited and are allocated at our discretion. Meeting the stated prerequisites does not by itself entitle any person to a seat.
(c) The written confirmation of enrolment, together with these Terms and our Privacy Policy, forms the agreement between you and us in respect of that Programme. Where the confirmation of enrolment expressly addresses a matter differently, the confirmation of enrolment prevails for that Programme.
(d) Enrolment is personal to you. You may not transfer your seat to another person without our written consent.
(a) Fees are quoted in Bangladeshi Taka (BDT) and are as stated in your confirmation of enrolment or, where applicable, on the Website at the time of enrolment.
(b) Fees may presently be paid in cash at the Facility, by bank transfer, or through mobile financial services such as bKash or Nagad, in each case only to the accounts we confirm to you in writing. We expect to enable online card and payment-gateway options during 2026; where we do, those payments will be processed by licensed third-party payment service providers under their own terms, and we will not store your full card or account credentials.
(c) Always obtain a receipt for any cash payment. We accept no responsibility for any amount paid to a person or account that we have not confirmed to you in writing.
(d) Unless expressly stated otherwise, fees are exclusive of VAT and any other applicable taxes, levies or bank charges, which you bear. Where law requires a deduction or withholding, the parties shall comply and provide the relevant certificate.
(e) Cancellation, deferral, transfer and refund arrangements for a Programme are dealt with in the enrolment documentation issued for that Programme.
(f) Where a fee instalment remains unpaid after written reminder, we may suspend access to the Programme and the Facility until it is settled.
(a) Each batch has a minimum viable cohort size. Where that number is not reached, or where circumstances reasonably require, we may postpone, reschedule, merge or cancel a batch.
(b) We may change session timings, change the venue between our own facilities, substitute an instructor of comparable competence, or deliver sessions in an alternative mode where necessary to maintain continuity.
(c) We will notify you of any material change using the contact details on record and, where a batch is cancelled by us, will offer a transfer to the next available batch or such other remedy as is set out in the enrolment documentation.
(a) Our workstations, electronic design automation (EDA) software, process design kits (PDKs), standard-cell and IP libraries, reference designs, documentation and lab data are licensed to us by third parties, including EDA vendors and semiconductor foundries, on restrictive terms. They are made available to you solely for the purpose of your Programme, only within the Facility and only on systems we provide, unless we state otherwise in writing.
You must not:
– copy, download, photograph, transmit, publish or otherwise remove any software, licence file, PDK, library, design database, script or documentation from the Facility, in any form;
– reverse-engineer, decompile, disassemble, modify or attempt to circumvent any licence control, dongle, key or usage restriction;
– use any tool, PDK or library for commercial work, for a third party, for another organisation, or for any purpose outside your Programme;
– share your login credentials, or use another person’s credentials;
– connect unauthorised devices, removable storage or network equipment to lab systems, or install any software on them.
(b) EDA software, PDKs and semiconductor design technology may be subject to export control and sanctions laws of Bangladesh and of other jurisdictions, including those of the country in which a vendor is established. We may refuse, condition or withdraw access where we consider this necessary to comply with such laws or with our obligations to a vendor, foundry or client.
(c) A breach of this clause 10 is a material breach of these Terms. It may also expose you to claims by the relevant vendor, foundry or client, for which you are responsible.
(a) During a Programme you may be given access to confidential information belonging to us, to companies within our group, or to our clients, foundries and vendors — including PDKs and libraries held under non-disclosure agreement, design data, methodologies, flows, scripts, commercial terms and business information.
(b) You must keep all such information strictly confidential, use it only for the purpose of your Programme, and not disclose, publish or reproduce it in any form, including on social media, in a portfolio, in a CV, in an academic submission, or to a subsequent employer.
(c) These obligations continue after your Programme ends and are not limited in time in respect of information that remains confidential.
(d) We may require you to sign a separate non-disclosure agreement before certain Programmes, laboratory sessions or industrial attachments, and participation may be conditional on your doing so.
(a) We issue an RFID access card to each Trainee for entry to the Facility and for recording attendance. The card is personal to you. You must not lend, share or duplicate it, and you must report loss or theft to us immediately.
(b) The card remains our property and must be returned on completion of your Programme or on earlier termination. A replacement fee may apply.
(c) A minimum attendance level may be a condition of assessment or of the award of a certificate. The requirement, where it applies, is stated in the Programme information.
(d) Attendance data is personal data and is handled as described in our Privacy Policy.
(a) Certificates are awarded to Trainees who meet the stated attendance, assessment and conduct requirements of the Programme.
(b) Some Programmes may lead to a credential issued or recognised by an EDA vendor or another third party. Those credentials are subject to the issuing organisation’s own criteria, terms and verification arrangements. The decision to issue is that organisation’s and not ours, and issuance may require us to share limited personal data with them as described in our Privacy Policy.
(c) Plagiarism, impersonation, unauthorised collaboration, or falsification of any submission or record invalidates the assessment concerned. We may withhold, suspend or revoke a certificate and record the fact of revocation.
(d) A certificate confirms participation and attainment in the Programme. It is not a professional licence, a warranty of competence to any employer, or a guarantee of employability.
(a) All curricula, course materials, slides, exercises, laboratory manuals, assessments, recordings, the ARTIS name and logo, and all Website content are owned by or licensed to ACI Semiconductor Limited and are protected by the applicable intellectual property laws of Bangladesh and by international treaty.
(b) We grant you a limited, personal, non-exclusive, non-transferable and revocable right to use the materials issued to you for your own learning in connection with your Programme.
(c) You must not reproduce, sell, sub-licence, redistribute, upload to any public or shared repository, or make any commercial use of those materials, and you must not use them, in whole or in part, to develop or train any automated system or machine-learning model, without our prior written consent.
(d) No right, title or interest in our intellectual property passes to you under these Terms.
(a) You retain ownership of the original work you personally create during a Programme, except to the extent that it incorporates or is derived from our materials, a third party’s pre-existing intellectual property, a PDK, a library, or confidential material, all of which remain the property of their respective owners.
(b) You grant us a non-exclusive, royalty-free, perpetual licence to retain and use your project work for assessment, moderation, quality assurance, accreditation, audit and internal record-keeping purposes.
(c) We will seek your separate, specific consent before publishing or otherwise using your project work publicly, including in marketing material.
(d) Work produced during an industrial attachment, a sponsored project or a client engagement may be subject to a separate agreement with the relevant organisation. Where such an agreement exists, it prevails over this clause 15 in respect of that work.
While engaging with us, whether at the Facility, online, or at any event, you agree to:
– behave professionally and treat instructors, staff and fellow participants with respect;
– refrain from harassment, bullying, discrimination, abusive language and any conduct that creates an intimidating environment;
– avoid disruptive behaviour, and not attend under the influence of alcohol or any prohibited substance;
– not photograph, record or stream any session, screen, or other participant without our prior written permission and, where relevant, the consent of the persons concerned;
– follow the reasonable instructions of instructors and Facility staff;
– not misrepresent your relationship with ACI Semiconductor Limited or ARTIS, or use our name or logo without written authorisation.
(a) You must comply with all safety instructions, signage, equipment-handling rules and emergency procedures in force at the Facility, and must report any accident, injury, near miss or equipment fault immediately.
(b) We may refuse entry to, or require the departure of, any person who poses a risk to safety, security or the orderly conduct of a Programme.
(c) You are responsible for your own personal belongings at the Facility.
(a) Closed-circuit television (CCTV) operates in and around the Facility, including laboratory areas, for the security and safety of people and the protection of equipment and licensed materials. CCTV is not installed in washrooms, prayer rooms or changing areas.
(b) Our systems, networks and workstations are monitored for information security, licence compliance and the protection of confidential material.
(c) Details of what is recorded, why, how long it is kept and your rights in relation to it are set out in our Privacy Policy.
(a) Career counselling, mentor connect, industrial attachment and placement support are offered subject to availability, eligibility and the requirements of the relevant partner organisation.
(b) We will share your profile, curriculum vitae, project work or assessment results with a prospective employer, an OSAT or design-house partner, or another company within our group, only where you have given us your prior consent for that purpose. You may decline, and you may withdraw a consent already given, at any time and without affecting your Programme.
(c) Where you are placed with a partner organisation for an industrial attachment, that organisation’s own rules, policies and agreements apply to you for the duration of the attachment, in addition to these Terms.
(d) Any offer of employment or engagement made by a partner organisation is a matter between you and that organisation. We are not a party to it and are not responsible for it.
(a) We may photograph or film classes, laboratory sessions, events and ceremonies for record-keeping and promotional purposes. If you do not wish your image to be used in promotional material, tell us in writing and we will take reasonable steps to exclude or obscure it.
(b) We will use a testimonial, quotation or named success story only with your specific consent, which you may withdraw for future use.
(a) We may suspend or terminate your access to a Programme, the Website and the Facility, with immediate effect and on written notice, where you commit a material breach of these Terms, and in particular where there is misconduct, a breach of clause 10 or clause 11, a risk to safety or security, provision of false information, or non-payment of fees after written reminder.
(b) On suspension or termination we may withdraw Facility and system access and withhold any certificate. The financial consequences, if any, are governed by the enrolment documentation for that Programme.
(c) You may withdraw from a Programme by written notice to us. The effect of withdrawal on fees is governed by the enrolment documentation.
(d) Clauses 10, 11, 14, 15, 24, 25, 28 and 29 survive termination.
We are not liable for any delay, interruption, rescheduling, suspension or failure to deliver a Programme that results from an event beyond our reasonable control, including:
– natural disaster, flood, cyclone, earthquake or fire;
– act of government, regulatory change, order, restriction or the refusal or withdrawal of any permission or licence;
– failure or interruption of electricity supply, internet connectivity or technical infrastructure;
– withdrawal, suspension or interruption of a third-party software licence or of foundry or vendor access;
– political unrest, hartal, strike, civil disturbance or act of terrorism;
– epidemic, pandemic or other public health emergency, or any measure taken in response to it.
Where such an event occurs, we will take reasonable steps to reschedule the affected sessions or to deliver them in an alternative mode.
(a) The Website and its content are provided on an “as is” and “as available” basis. We do not warrant that the Website will be uninterrupted, timely, secure or free from error.
(b) Course content is provided for education and training. It does not constitute professional, engineering or design advice for any specific project, and must not be relied upon as such.
(c) The Website may link to third-party sites. We do not control them, do not endorse them, and are not responsible for their content or practices.
(a) To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, opportunity, employment prospects, goodwill or data, arising out of or in connection with these Terms, the Website or any Programme.
(b) To the fullest extent permitted by law, our total aggregate liability arising out of or in connection with a Programme is limited to the total fees actually received by us from you for that Programme.
(c) Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under the law of Bangladesh, including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
You agree to indemnify us against any loss, damage, cost, expense or third-party claim that we incur as a result of your breach of clause 10, clause 11, clause 14 or clause 16, or as a result of any unlawful act or omission on your part.
We handle your personal data in accordance with our Privacy Policy, which forms part of these Terms and is aligned with the Personal Data Protection Act, 2026 (Act No. 63 of 2026). Please read it before submitting any personal data to us.
(a) We may amend these Terms from time to time. The current version is published on the Website with its effective date, and it applies from that date.
(b) Where a change is material and affects Trainees currently enrolled, we will give notice using the contact details on record.
(c) Your continued use of the Website or of our services after the effective date constitutes acceptance of the amended Terms. An amendment does not retrospectively alter the fee already agreed for a Programme in which you are already enrolled.
(a) These Terms and any dispute arising out of or in connection with them are governed by the law of the People’s Republic of Bangladesh.
(b) The parties will first attempt in good faith to resolve any dispute by discussion within thirty (30) days of written notice of the dispute.
(c) Failing resolution, the courts of Dhaka, Bangladesh have exclusive jurisdiction.
(a) These Terms are published in English and in Bangla. Both versions are official texts, both are equally binding, and the clause numbering of the two versions is identical.
(b) The two versions are to be read together as a single instrument and, so far as possible, are to be interpreted so as to be consistent with one another.
(c) If a difference between the two versions cannot be reconciled by such interpretation, the meaning that prevails is the one that best gives effect to the common intention of the parties, read in the context of the document as a whole and of the purpose of the clause concerned, and that is consistent with the mandatory law of Bangladesh.
(d) Neither version is to be treated as subordinate to the other, or construed against either party, on the ground that it is a translation.
(a) If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions continue in full force, and the invalid provision is to be replaced by a valid one that most closely reflects its purpose.
(b) A failure or delay by us in enforcing any provision is not a waiver of it.
(c) You may not assign or transfer your rights under these Terms. We may assign our rights to a successor in business or to a company within our group.
(d) These Terms, together with the Privacy Policy and your confirmation of enrolment, constitute the entire agreement between you and us in respect of their subject matter and supersede any prior discussion or representation.
(e) Headings are for convenience only and do not affect interpretation.

এই শর্তাবলিতে (“শর্তাবলি”):
(ক) “এসিআই সেমিকন্ডাক্টর”, “আমরা” বা “আমাদের” বলতে বাংলাদেশে নিবন্ধিত কোম্পানি ACI Semiconductor Limited বুঝাবে, যার কার্যালয় অ্যারিস্টো টাওয়ার (লেভেল ৩), ২৩৯ বীর উত্তম মীর শওকত সরক (তেজগাঁও–গুলশান লিঙ্ক রোড), ঢাকা ১২০৮, বাংলাদেশ।
(খ) “আর্টিস (ARTIS)” বলতে ACI Semiconductor Limited কর্তৃক পরিচালিত প্রশিক্ষণ প্রতিষ্ঠান Advanced Research & Training Institute for Semiconductor বুঝাবে। আর্টিস ACI Semiconductor Limited-এর একটি ব্র্যান্ড ও পরিচালন ইউনিট, আলাদা আইনি সত্তা নয়; এই শর্তাবলির অধীনে চুক্তির পক্ষ হলো ACI Semiconductor Limited।
(গ) “ওয়েবসাইট” বলতে www.acisemi.com এবং ইহার সকল পৃষ্ঠা ও সাব-ডোমেইন বুঝাবে।
(ঘ) “প্রোগ্রাম” বলতে আমাদের প্রদত্ত যেকোনো কোর্স, কর্মশালা, সেমিনার, ইন্ডাস্ট্রিয়াল অ্যাটাচমেন্ট বা অন্য প্রশিক্ষণ কার্যক্রম বুঝাবে।
(ঙ) “প্রশিক্ষণার্থী” বলতে এমন ব্যক্তিকে বুঝাবে যাঁর ভর্তি আমরা নিশ্চিত করেছি।
(চ) “আপনি” বলতে ওয়েবসাইটের যেকোনো দর্শনার্থী, অনুসন্ধান বা আবেদনকারী এবং যেকোনো প্রশিক্ষণার্থীকে বুঝাবে।
(ছ) “সুবিধাকেন্দ্র” বলতে আমাদের প্রশিক্ষণ প্রাঙ্গণ, শ্রেণিকক্ষ, ল্যাবরেটরি, ওয়ার্কস্টেশন, সরঞ্জাম ও নেটওয়ার্ক বুঝাবে।
(জ) “ব্যক্তিগত উপাত্ত” বলতে ব্যক্তিগত উপাত্ত সুরক্ষা আইন, ২০২৬ (২০২৬ সনের ৬৩ নং আইন)-এ প্রদত্ত অর্থ বুঝাবে।
(ক) ওয়েবসাইট ব্যবহার, অনুসন্ধান বা আগ্রহ প্রকাশ বা আবেদন জমাদান, অথবা কোনো প্রোগ্রামে ভর্তির মাধ্যমে আপনি নিশ্চিত করছেন যে, আপনি এই শর্তাবলি পড়েছেন, বুঝেছেন এবং গ্রহণ করেছেন।
(খ) এই শর্তাবলি গ্রহণযোগ্য না হলে অনুগ্রহ করে ওয়েবসাইট বা আমাদের সেবা ব্যবহার করবেন না।
(ক) আমাদের প্রোগ্রাম ও সশুল্ক সেবা কেবল ১৮ বছর বা তদূর্ধ্ব বয়সের ব্যক্তিদের জন্য প্রযোজ্য। আমরা জেনেশুনে কোনো অপ্রাপ্তবয়স্ককে ভর্তি করি না এবং তার ব্যক্তিগত উপাত্ত সংগ্রহ করি না।
(খ) আপনি নিশ্চিত করছেন যে, আপনার প্রদত্ত তথ্য সত্য, সম্পূর্ণ ও হালনাগাদ, এবং পরিবর্তন হলে আপনি তা দ্রুত জানাবেন।
(গ) কিছু প্রোগ্রামে পূর্বশর্ত বা প্রার্থিত পূর্বজ্ঞান থাকতে পারে। আমরা তা যাচাই করতে পারি এবং একাডেমিক, ধারণক্ষমতা বা সময়সূচিগত কারণে কোনো আবেদন অগ্রাহ্য, স্থগিত বা অন্য প্রোগ্রামে পুনর্নির্দেশ করতে পারি।
(ক) আমরা সেমিকন্ডাক্টর ও ভিএলএসআই প্রশিক্ষণ, তত্ত্বাবধানে ল্যাবরেটরি ব্যবহারের সুযোগ, মেন্টরিং, মূল্যায়ন, সন্দায়ন এবং ক্যারিয়ার সহায়তা প্রদান করি।
(খ) ক্যারিয়ার কাউন্সেলিং, মেন্টর কানেক্ট, ইন্ডাস্ট্রিয়াল অ্যাটাচমেন্ট এবং প্লেসমেন্ট সহায়তা কেবল সহায়ক সেবা। আমরা কোনো চাকরি, ইন্টার্নশিপ, প্লেসমেন্ট, সাক্ষাৎকার, নির্দিষ্ট বেতন বা অন্য কোনো নির্দিষ্ট ফলাফলের নিশ্চয়তা দেই না।
(গ) ওয়েবসাইট বা আমাদের প্রচারণায় প্রকাশিত প্লেসমেন্ট বা সমাপনসংক্রান্ত যেকোনো পরিসংখ্যান পূর্ববর্তী ব্যাচের ফলাফল বর্ণনা করে মাত্র; তা আপনার নিজস্ব ফলাফল সম্পর্কে কোনো প্রতিশ্রুতি নয়।
(ঘ) পাঠ্যসূচি, টুল, টুলের সংস্করণ, প্রশিক্ষক, প্রদানপদ্ধতি ও সময়সূচি শিল্পের বাস্তবতার সঙ্গে সঙ্গতি রাখতে সময়ে সময়ে হালনাগাদ করা হতে পারে।
আপনি সম্মত হচ্ছেন যে, আপনি:
– অবৈধ, প্রতারণামূলক বা বিভ্রান্তিকর উদ্দেশ্যে ওয়েবসাইট ব্যবহার করবেন না;
– ওয়েবসাইট, আমাদের সিস্টেম বা কোনো অ্যাকাউন্টে অনুমতিবিহীন প্রবেশের চেষ্টা করবেন না;
– ক্ষতিকর কোড প্রবেশ করাবেন না বা ওয়েবসাইটের স্বাভাবিক পরিচালনায় বিঘ্ন ঘটাবেন না;
– স্বয়ংক্রিয় পদ্ধতিতে কন্টেন্ট বা যোগাযোগের তথ্য সংগ্রহ বা নিষ্কাশন করবেন না;
– আমাদের কোনো ফর্ম বা ফিচারের মাধ্যমে অবৈধ, মানহানিকর, আপত্তিকর, অশ্লীল বা স্বত্বলঙ্ঘনকারী বিষয়বস্তু প্রকাশ বা প্রেরণ করবেন না।
এসব কাজের কিছু সাইবার সুরক্ষা আইন, ২০২৬ এবং অন্যান্য প্রযোজ্য আইনের অধীনে অপরাধ হিসাবে গণ্য হতে পারে।
(ক) আপনি ওয়েবসাইটের মাধ্যমে অনুসন্ধান বা আগ্রহ প্রকাশ জমা দিতে পারেন। ইহাতে কোনো চুক্তি সৃষ্টি হয় না, ইহা ভর্তির আবেদন নয় এবং ইহাদ্বারা কোনো আসন সংরক্ষিত হয় না।
(খ) আপনার দেওয়া যোগাযোগের তথ্য ব্যবহার করে আমরা আপনার সঙ্গে যোগাযোগ করব এবং আগ্রহ প্রকাশ করা সাপেক্ষে প্রাসঙ্গিক প্রোগ্রাম সম্পর্কে জানাব। আপনি যেকোনো সময় যোগাযোগ বন্ধ করতে বলতে পারেন।
(ক) আমরা লিখিতভাবে ভর্তি নিশ্চিতকরণ ইস্যু করলে এবং তদনুযায়ী প্রযোজ্য ফি প্রাপ্ত হলেই কেবল ভর্তি নিশ্চিত বলে গণ্য হবে।
(খ) প্রতিটি ব্যাচে আসনসংখ্যা সীমিত এবং আসন বর্ণ্টনের এখতিয়ার আমাদের। পূর্বশর্ত পূরণ করলেই কোনো ব্যক্তি আসন পাওয়ার অধিকারী হন না।
(গ) লিখিত ভর্তি নিশ্চিতকরণ, এই শর্তাবলি এবং আমাদের গোপনীয়তা নীতি — এই তিনটি মিলে সংশ্লিষ্ট প্রোগ্রাম সম্পর্কে আপনার ও আমাদের মধ্যে চুক্তি গঠিত হয়। ভর্তি নিশ্চিতকরণে কোনো বিষয় ভিন্নভাবে সুস্পষ্টভাবে বর্ণিত হলে সেই প্রোগ্রামের ক্ষেত্রে ভর্তি নিশ্চিতকরণ প্রাধান্য পাবে।
(ঘ) ভর্তি ব্যক্তিগত; আমাদের লিখিত সম্মতি ছাড়া আপনি আপনার আসন অন্য কাউকে হস্তান্তর করতে পারবেন না।
(ক) ফি বাংলাদেশি টাকায় (BDT) নির্ধারিত এবং আপনার ভর্তি নিশ্চিতকরণে অথবা ভর্তির সময় ওয়েবসাইটে প্রকাশিত হার অনুযায়ী প্রযোজ্য হবে।
(খ) বর্তমানে সুবিধাকেন্দ্রে নগদে, ব্যাংক ট্রান্সফারে অথবা বিকাশ বা নগদের মতো মোবাইল ফিন্যান্সিয়াল সার্ভিসের মাধ্যমে ফি পরিশোধ করা যাবে, প্রতিটি ক্ষেত্রে কেবল আমাদের লিখিতভাবে নিশ্চিত করা অ্যাকাউন্টে। ২০২৬ সালের মধ্যে অনলাইন কার্ড ও পেমেন্ট গেটওয়ে চালু করার পরিকল্পনা রয়েছে; সেই লেনদেন লাইসেন্সপ্রাপ্ত তৃতীয় পক্ষীয় পেমেন্ট সার্ভিস প্রদানকারীর নিজস্ব শর্তে পরিচালিত হবে এবং আমরা আপনার সম্পূর্ণ কার্ড বা অ্যাকাউন্টের তথ্য সংরক্ষণ করব না।
(গ) নগদে পরিশোধের ক্ষেত্রে অবশ্যই রসিদ নেবেন। আমাদের লিখিতভাবে নিশ্চিত করা হয়নি এমন কোনো ব্যক্তি বা অ্যাকাউন্টে পরিশোধিত অর্থের দায় আমরা নেব না।
(ঘ) ভিন্নরূপ সুস্পষ্টভাবে উল্লেখ না থাকলে ফি-তে ভ্যাট বা অন্যান্য প্রযোজ্য কর, শুল্ক ও ব্যাংক চার্জ অন্তর্ভুক্ত নয়; তা আপনাকে বহন করতে হবে। আইন অনুযায়ী উৎসে কর কর্তনের প্রয়োজন হলে উভয় পক্ষ তা পরিপালন করবে এবং প্রয়োজনীয় সনদ সরবরাহ করবে।
(ঙ) কোনো প্রোগ্রামের বাতিলকরণ, স্থগিতকরণ, হস্তান্তর ও অর্থ ফেরতসংক্রান্ত বিষয় সংশ্লিষ্ট প্রোগ্রামের ভর্তি-ডকুমেন্টেশনে বর্ণিত হবে।
(চ) লিখিত তাগিদের পরে কোনো কিস্তি অপরিশোধিত থাকলে পরিশোধ না হওয়া পর্যন্ত আমরা প্রোগ্রাম ও সুবিধাকেন্দ্রে প্রবেশ স্থগিত করতে পারি।
(ক) প্রতিটি ব্যাচের একটি ন্যূনতম শিক্ষার্থীসংখ্যা রয়েছে। সেই সংখ্যা পূরণ না হলে অথবা যুক্তিসঙ্গত পরিস্থিতিতে আমরা কোনো ব্যাচ স্থগিত, পুনর্নির্ধারণ, একীকরণ বা বাতিল করতে পারি।
(খ) প্রয়োজনে আমরা ক্লাসের সময় পরিবর্তন, নিজস্ব সুবিধাকেন্দ্রগুলোর মধ্যে ভেন্যু পরিবর্তন, সমতুল্য দক্ষতাসম্পন্ন প্রশিক্ষক প্রতিস্থাপন, অথবা বিকল্প পদ্ধতিতে সেশন পরিচালনা করতে পারি।
(গ) গুরুত্বপূর্ণ পরিবর্তনের ক্ষেত্রে সংরক্ষিত যোগাযোগের ঠিকানায় আমরা আপনাকে জানাব; এবং আমরা কোনো ব্যাচ বাতিল করলে পরবর্তী ব্যাচে স্থানান্তরের সুযোগ অথবা ভর্তি-ডকুমেন্টেশনে বর্ণিত অন্য প্রতিকার প্রস্তাব করব।
(ক) আমাদের ওয়ার্কস্টেশন, ইলেক্ট্রনিক ডিজাইন অটোমেশন (EDA) সফটওয়্যার, প্রসেস ডিজাইন কিট (PDK), স্ট্যান্ডার্ড-সেল ও আইপি লাইব্রেরি, রেফারেন্স ডিজাইন, ডকুমেন্টেশন ও ল্যাব ডেটা তৃতীয় পক্ষ — যেমন ইডিএ ভেন্ডর ও সেমিকন্ডাক্টর ফাউন্ড্রি — কর্তৃক কোর শর্তে আমাদের লাইসেন্স দেওয়া। লিখিতভাবে অন্যরকম বলা না হলে এগুলি কেবল আপনার প্রোগ্রামের প্রয়োজনে, শুধুমাত্র সুবিধাকেন্দ্রের ভেতরে এবং আমাদের সরবরাহকৃত সিস্টেমে ব্যবহারযোগ্য।
আপনি করতে পারবেন না:
– কোনো সফটওয়্যার, লাইসেন্স ফাইল, PDK, লাইব্রেরি, ডিজাইন ডেটাবেস, স্ক্রিপ্ট বা ডকুমেন্টেশন যেকোনো রূপে কপি, ডাউনলোড, ছবি ধারণ, প্রেরণ, প্রকাশ বা সুবিধাকেন্দ্রের বাইরে নিয়ে যাওয়া;
– রিভার্স-ইঞ্জিনিয়ারিং, ডিকম্পাইল, ডিসঅ্যাসেম্বল করা অথবা লাইসেন্স নিয়ন্ত্রণ এড়ানোর চেষ্টা করা;
– প্রোগ্রামের বাইরে বাণিজ্যিক কাজে, অন্য কোনো প্রতিষ্ঠানের জন্য বা অন্য কোনো উদ্দেশ্যে এসব ব্যবহার করা;
– নিজের লগইন তথ্য অন্যর সঙ্গে ভাগ করা বা অন্যের লগইন ব্যবহার করা;
– ল্যাব সিস্টেমে অনুমোদনহীন ডিভাইস, স্টোরেজ বা নেটওয়ার্ক সরঞ্জাম সংযুক্ত করা বা সফটওয়্যার ইনস্টল করা।
(খ) ইডিএ সফটওয়্যার, PDK এবং সেমিকন্ডাক্টর ডিজাইন প্রযুক্তি বাংলাদেশ এবং অন্যান্য এখতিয়ারের রপ্তানি-নিয়ন্ত্রণ ও নিষেধাজ্ঞাসংক্রান্ত আইনের আওতায় পড়তে পারে। এসব আইন বা ভেন্ডর, ফাউন্ড্রি ও ক্লায়েন্টের নিকট আমাদের দায় পরিপালনের প্রয়োজনে আমরা প্রবেশাধিকার অস্বীকার, শর্তযুক্ত বা প্রত্যাহার করতে পারি।
(গ) এই ১০ নং ধারা লঙ্ঘন একটি গুরুতর চুক্তিভঙ্গ। ইহাতে সংশ্লিষ্ট ভেন্ডর, ফাউন্ড্রি বা ক্লায়েন্টের দাবির সম্মুখীন হওয়ার ঝুঁকি রয়েছে, যার দায় আপনার।
(ক) প্রোগ্রাম চলাকালে আপনি আমাদের, আমাদের গ্রুপভুক্ত কোম্পানির, অথবা আমাদের ক্লায়েন্ট, ফাউন্ড্রি ও ভেন্ডরের গোপনীয় তথ্যে প্রবেশাধিকার পেতে পারেন — যার মধ্যে রয়েছে গোপনীয়তা চুক্তির অধীন PDK ও লাইব্রেরি, ডিজাইন ডেটা, পদ্ধতি, ফ্লো, বাণিজ্যিক শর্ত ও ব্যবসায়িক তথ্য।
(খ) এসব তথ্য আপনাকে কোরভাবে গোপন রাখতে হবে, কেবল প্রোগ্রামের উদ্দেশ্যে ব্যবহার করতে হবে, এবং সোশ্যাল মিডিয়া, পোর্টফোলিও, জীবনবৃত্তান্ত, একাডেমিক সাবমিশন বা পরবর্তী নিয়োগকর্তাসহ কারো কাছে প্রকাশ বা পুনরুৎপাদন করা যাবে না।
(গ) প্রোগ্রাম শেষ হওয়ার পরেও এই দায় বলবৎ থাকবে এবং যতক্ষণ তথ্য গোপনীয় থাকে ততক্ষণ তা সময়সীমাহীন।
(ঘ) কিছু প্রোগ্রাম, ল্যাব সেশন বা ইন্ডাস্ট্রিয়াল অ্যাটাচমেন্টের আগে আমরা আলাদা গোপনীয়তা চুক্তি (NDA) স্বাক্ষর করতে বলতে পারি; অংশগ্রহণ তার উপর শর্তাধীন হতে পারে।
(ক) প্রতিজন প্রশিক্ষণার্থীকে সুবিধাকেন্দ্রে প্রবেশ ও উপস্থিতি রেকর্ডের জন্য একটি RFID অ্যাক্সেস কার্ড দেওয়া হয়। কার্ডটি ব্যক্তিগত; ইহা ধার দেওয়া, ভাগাভাগি বা নকল করা যাবে না এবং হারালে বা চুরি হলে তাৎক্ষণিকভাবে জানাতে হবে।
(খ) কার্ডটি আমাদের সম্পত্তি এবং প্রোগ্রাম শেষে বা তার আগে অবসান ঘটলে ফেরত দিতে হবে। প্রতিস্থাপন ফি প্রযোজ্য হতে পারে।
(গ) ন্যূনতম উপস্থিতি মূল্যায়ন বা সনদ প্রদানের শর্ত হতে পারে। প্রযোজ্য হলে তা প্রোগ্রামের তথ্যে উল্লেখ করা থাকবে।
(ঘ) উপস্থিতির উপাত্ত ব্যক্তিগত উপাত্ত; ইহা আমাদের গোপনীয়তা নীতি অনুযায়ী পরিচালিত হয়।
(ক) প্রোগ্রামের নির্ধারিত উপস্থিতি, মূল্যায়ন ও আচরণসংক্রান্ত শর্ত পূরণকারী প্রশিক্ষণার্থীদের সনদ প্রদান করা হয়।
(খ) কিছু প্রোগ্রামে ইডিএ ভেন্ডর বা অন্য তৃতীয় পক্ষ কর্তৃক প্রদত্ত বা স্বীকৃত ক্রেডেনশিয়াল পাওয়া যায়। এসব ক্রেডেনশিয়াল সংশ্লিষ্ট প্রতিষ্ঠানের নিজস্ব মানদণ্ড, শর্ত ও যাচাই পদ্ধতির অধীন। প্রদানের সিদ্ধান্ত তাদের, আমাদের নয়; এবং ইহার জন্য আমাদের গোপনীয়তা নীতিতে বর্ণিত পন্থায় সীমিত ব্যক্তিগত উপাত্ত শেয়ার করতে হতে পারে।
(গ) স্বত্বচুরি, ছদ্মপরিচয় প্রদান, অনুমোদনহীন পারস্পরিক সহযোগিতা বা কোনো নথি জালিয়াতি সংশ্লিষ্ট মূল্যায়নকে বাতিল করে। আমরা সনদ স্থগিত, প্রত্যাখ্যান বা প্রত্যাহার করতে এবং প্রত্যাহারের বিষয়টি রেকর্ড করতে পারি।
(ঘ) সনদ প্রোগ্রামে অংশগ্রহণ ও অর্জনের প্রমাণ; ইহা কোনো পেশাগত লাইসেন্স, নিয়োগকর্তার কাছে দক্ষতার ওয়ারেন্টি বা চাকরির নিশ্চয়তা নয়।
(ক) সকল পাঠ্যসূচি, কোর্স সামগ্রী, স্লাইড, অনুশীলনী, ল্যাব ম্যানুয়াল, মূল্যায়নপত্র, রেকর্ডিং, ARTIS নাম ও লোগো এবং ওয়েবসাইটের সমস্ত কন্টেন্ট ACI Semiconductor Limited-এর মালিকানাধীন বা লাইসেন্সকৃত এবং বাংলাদেশের প্রযোজ্য মেধাস্বত্ব আইন ও আন্তর্জাতিক চুক্তির দ্বারা সংরক্ষিত।
(খ) আপনাকে প্রদত্ত সামগ্রী কেবল নিজের শিক্ষার জন্য ব্যবহারের একটি সীমিত, ব্যক্তিগত, অ-একজ্রিকিউজিভ, অহস্তান্তরযোগ্য ও প্রত্যাহারযোগ্য অধিকার দেওয়া হল।
(গ) আমাদের পূর্বানুমতি ছাড়া এসব সামগ্রী পুনরুৎপাদন, বিক্রয়, সাব-লাইসেন্স, পুনর্বন্টন, কোনো উন্মুক্ত বা শেয়ার্ড রিপোজিটরিতে আপলোড বা বাণিজ্যিক ব্যবহার করা যাবে না; এবং আংশিক বা সম্পূর্ণভাবে কোনো স্বয়ংক্রিয় সিস্টেম বা মেশিন-লার্নিং মডেল প্রশিক্ষণ বা তৈরিতে ব্যবহার করা যাবে না।
(ঘ) এই শর্তাবলির অধীনে আমাদের মেধাস্বত্বের কোনো স্বত্ব, মালিকানা বা স্বার্থ আপনার অনুকূলে হস্তান্তরিত হয় না।
(ক) প্রোগ্রাম চলাকালে আপনার নিজের তৈরি মৈলিক কাজের মালিকানা আপনারই থাকবে; তবে তাতে আমাদের সামগ্রী, তৃতীয় পক্ষের পূর্ববর্তী মেধাস্বত্ব, PDK, লাইব্রেরি বা গোপনীয় সামগ্রী যতটুকু যুক্ত রয়েছে, তার মালিকানা সংশ্লিষ্ট মালিকেরই থাকবে।
(খ) মূল্যায়ন, মডারেশন, গুণগত মান নিশ্চিতকরণ, স্বীকৃতি, নিরীক্ষা ও অভ্যন্তরীণ নথি সংরক্ষণের উদ্দেশ্যে আপনার প্রজেক্ট কাজ সংরক্ষণ ও ব্যবহারের একটি অ-একজ্রিকিউজিভ, রয়াল্টিমুক্ত, স্থায়ী লাইসেন্স আপনি আমাদের প্রদান করছেন।
(গ) প্রচারণাসহ জনসমক্ষে আপনার প্রজেক্ট কাজ ব্যবহারের আগে আমরা আপনার আলাদা ও সুনির্দিষ্ট সম্মতি নেব।
(ঘ) ইন্ডাস্ট্রিয়াল অ্যাটাচমেন্ট, স্পন্সরকৃত প্রজেক্ট বা ক্লায়েন্ট-কাজের ক্ষেত্রে পৃথক চুক্তি প্রযোজ্য হতে পারে; সেই ক্ষেত্রে সেই চুক্তি এই ১৫ নং ধারার উপর প্রাধান্য পাবে।
সুবিধাকেন্দ্রে, অনলাইনে বা যেকোনো ইভেন্টে আপনি সম্মত হচ্ছেন:
– পেশাদার আচরণ করতে এবং প্রশিক্ষক, কর্মী ও সহপাঠীদের প্রতি শ্রদ্ধাশীল থাকতে;
– হয়রানি, উত্পীড়ন, বৈষম্য, অশ্রাব্য ভাষা এবং ভয়াবহ পরিবেশ সৃষ্টিকারী আচরণ থেকে বিরত থাকতে;
– বিশৃঙ্খল আচরণ পরিহার করতে এবং মদ্য বা নিষিদ্ধ দ্রব্যের প্রভাবে উপস্থিত না হতে;
– আমাদের পূর্বানুমতি এবং প্রয়োজ্য ক্ষেত্রে সংশ্লিষ্ট ব্যক্তির সম্মতি ছাড়া কোনো সেশন, স্ক্রিন বা অন্য অংশগ্রহণকারীর ছবি, রেকর্ডিং বা স্ট্রিম না করতে;
– প্রশিক্ষক ও কর্মীদের যুক্তিসঙ্গত নির্দেশ মানতে;
– ACI Semiconductor Limited বা ARTIS-এর সঙ্গে সম্পর্ক সম্পর্কে ভুল তথ্য না দিতে এবং লিখিত অনুমতি ছাড়া আমাদের নাম বা লোগো ব্যবহার না করতে।
(ক) সুবিধাকেন্দ্রে প্রচলিত সকল নিরাপত্তা নির্দেশনা, সাইনেজ, সরঞ্জাম ব্যবহারের বিধি ও জরুরি প্রস্থান প্রক্রিয়া মেনে চলতে হবে এবং যেকোনো দুর্ঘটনা, আঘাত বা যন্ত্রের ত্রুটি তাৎক্ষণিকভাবে জানাতে হবে।
(খ) নিরাপত্তা, সুরক্ষা বা প্রোগ্রামের শৃঙ্খলার জন্য ঝুঁকিস্বরূপ যেকোনো ব্যক্তির প্রবেশ নিষিদ্ধ করা বা তাঁকে চলে যেতে বলার অধিকার আমাদের রয়েছে।
(গ) সুবিধাকেন্দ্রে নিজস্ব জিনিসপত্রের দায়িত্ব আপনার।
(ক) মানুষের নিরাপত্তা ও সুরক্ষা এবং সরঞ্জাম ও লাইসেন্সকৃত সামগ্রী রক্ষার স্বার্থে ল্যাবসহ সুবিধাকেন্দ্র ও তার আশপাশে সিসিটিভি পরিচালিত হয়। ওয়াশরুম, নামাজঘর বা পোশাক পরিবর্তনের কক্ষে কোনো ক্যামেরা নেই।
(খ) তথ্যসুরক্ষা, লাইসেন্স পরিপালন ও গোপনীয় সামগ্রী রক্ষার জন্য আমাদের সিস্টেম, নেটওয়ার্ক ও ওয়ার্কস্টেশন পর্যবেক্ষণ করা হয়।
(গ) কী রেকর্ড করা হয়, কেন, কতদিন রাখা হয় এবং এ বিষয়ে আপনার অধিকার কী — তার বিস্তারিত আমাদের গোপনীয়তা নীতিতে বর্ণিত আছে।
(ক) ক্যারিয়ার কাউন্সেলিং, মেন্টর কানেক্ট, ইন্ডাস্ট্রিয়াল অ্যাটাচমেন্ট ও প্লেসমেন্ট সহায়তা প্রাপ্যতা, যোগ্যতা এবং সংশ্লিষ্ট অংশীদার প্রতিষ্ঠানের শর্ত সাপেক্ষে প্রদান করা হয়।
(খ) কেবল আপনার পূর্বসম্মতি সাপেক্ষেই আমরা আপনার প্রোফাইল, জীবনবৃত্তান্ত, প্রজেক্ট কাজ বা মূল্যায়নের ফলাফল সম্ভাব্য নিয়োগকর্তা, OSAT বা ডিজাইন-হাউস অংশীদার, অথবা আমাদের গ্রুপভুক্ত অন্য কোম্পানির সঙ্গে শেয়ার করব। আপনি অসম্মতি জানাতে পারেন এবং প্রদত্ত সম্মতি যেকোনো সময় প্রত্যাহার করতে পারেন; তাতে আপনার প্রোগ্রাম ক্ষতিগ্রস্ত হবে না।
(গ) কোনো অংশীদার প্রতিষ্ঠানে অ্যাটাচমেন্টের সময় এই শর্তাবলির পাশাপাশি সেই প্রতিষ্ঠানের নিজস্ব বিধি, নীতি ও চুক্তি আপনার উপর প্রযোজ্য হবে।
(ঘ) অংশীদার প্রতিষ্ঠানের দেওয়া যেকোনো চাকরি বা নিয়োগের প্রস্তাব আপনার এবং সেই প্রতিষ্ঠানের মধ্যেকার বিষয়। আমরা তার পক্ষ নই এবং তার জন্য দায়ী নই।
(ক) রেকর্ড সংরক্ষণ ও প্রচারণার উদ্দেশ্যে আমরা ক্লাস, ল্যাব সেশন, ইভেন্ট ও অনুষ্ঠানের ছবি বা ভিডিও ধারণ করতে পারি। প্রচারণায় নিজের ছবি ব্যবহার করতে না চাইলে লিখিতভাবে জানান; আমরা যুক্তিসঙ্গত ব্যবস্থা নেব।
(খ) কোনো প্রশংসাবাণী, উদ্ধৃতি বা নামসহ সাফল্যগাথা কেবল আপনার সুনির্দিষ্ট সম্মতিতে ব্যবহার করা হবে, যা ভবিষ্যৎ ব্যবহারের জন্য আপনি প্রত্যাহার করতে পারেন।
(ক) আপনি এই শর্তাবলি গুরুতরভাবে লঙ্ঘন করলে — বিশেষত অসদাচরণ, ১০ বা ১১ নং ধারা লঙ্ঘন, নিরাপত্তাঝুঁকি, মিথ্যা তথ্য প্রদান অথবা লিখিত তাগিদের পরও ফি অপরিশোধ থাকলে — আমরা লিখিত নোটিশে তাৎক্ষণিকভাবে প্রোগ্রাম, ওয়েবসাইট ও সুবিধাকেন্দ্রে আপনার প্রবেশাধিকার স্থগিত বা বাতিল করতে পারি।
(খ) স্থগিত বা অবসানের ক্ষেত্রে সুবিধাকেন্দ্র ও সিস্টেমে প্রবেশ প্রত্যাহার করা হতে পারে এবং সনদ স্থগিত রাখা হতে পারে। আর্থিক পরিণতি, যদি থাকে, সংশ্লিষ্ট প্রোগ্রামের ভর্তি-ডকুমেন্টেশন দ্বারা নিয়ন্ত্রিত হবে।
(গ) আপনি লিখিত নোটিশে প্রোগ্রাম থেকে অব্যাহতি নিতে পারেন। ফি-সংক্রান্ত পরিণতি ভর্তি-ডকুমেন্টেশন অনুযায়ী নির্ধারিত হবে।
(ঘ) ১০, ১১, ১৪, ১৫, ২৪, ২৫, ২৮ ও ২৯ নং ধারা অবসানের পরেও বলবৎ থাকবে।
আমাদের যুক্তিসঙ্গত নিয়ন্ত্রণের বাইরে কোনো ঘটনার কারণে প্রোগ্রাম প্রদানে বিলম্ব, বিঘ্ন, পুনর্নির্ধারণ, স্থগিতাদেশ বা ব্যর্থতা ঘটলে আমরা দায়ী থাকব না, যেমন:
– প্রাকৃতিক দুর্যোগ, বন্যা, ঘূর্ণিঝড়, ভূমিকম্প বা অগ্নিকাণ্ড;
– সরকারি সিদ্ধান্ত, বিধিমালার পরিবর্তন, নিষেধাজ্ঞা অথবা কোনো অনুমতি বা লাইসেন্স প্রত্যাখ্যান বা প্রত্যাহার;
– বিদ্যুৎ, ইন্টারনেট বা প্রযুক্তিগত অবকাঠামোর বিপর্যয়;
– তৃতীয় পক্ষের সফটওয়্যার লাইসেন্স অথবা ফাউন্ড্রি/ভেন্ডর অ্যাক্সেস প্রত্যাহার বা স্থগিত;
– রাজনৈতিক অস্থিরতা, হরতাল, ধর্মঘট, গোলযোগ বা সন্ত্রাসী কার্যকলাপ;
– মহামারি, জনস্বাস্থ্য জরুরি অবস্থা অথবা তদুপলক্ষে গৃহীত যেকোনো ব্যবস্থা।
এরূপ ঘটনায় আমরা ক্ষতিগ্রস্ত সেশন পুনর্নির্ধারণ অথবা বিকল্প পদ্ধতিতে পরিচালনার যুক্তিসঙ্গত চেষ্টা করব।
(ক) ওয়েবসাইট ও তার কন্টেন্ট “যেমন আছে” এবং “যতটুকু পাওয়া যায়” ভিত্তিতে সরবরাহ করা হয়। ওয়েবসাইট নিরবিচ্ছিন্ন, ত্রুটিমুক্ত বা সর্বদা নিরাপদ থাকবে — এমন ওয়ারেন্টি আমরা দিই না।
(খ) কোর্সের বিষয়বস্তু শিক্ষা ও প্রশিক্ষণের জন্য; ইহা কোনো নির্দিষ্ট প্রকল্পের জন্য পেশাদার বা প্রকৌশলগত পরামর্শ নয় এবং সেভাবে নির্ভরযোগ্য নয়।
(গ) ওয়েবসাইটে তৃতীয় পক্ষের লিঙ্ক থাকতে পারে। সেগুলি আমাদের নিয়ন্ত্রণে নয়; আমরা তাদের সমর্থন করি না এবং তাদের কন্টেন্ট বা অনুশীলনের জন্য দায়ী নই।
(ক) আইন অনুমোদিত সর্বোচ্চ সীমা পর্যন্ত, এই শর্তাবলি, ওয়েবসাইট বা কোনো প্রোগ্রামসংক্রান্ত কোনো পরোক্ষ, আনুষঙ্গিক, বিশেষ বা পরিণতিমূলক ক্ষতি, অথবা মুনাফা, আয়, সুযোগ, চাকরির সম্ভাবনা, সুনাম বা ডেটা হারানোর জন্য আমরা দায়ী থাকব না।
(খ) আইন অনুমোদিত সর্বোচ্চ সীমা পর্যন্ত, কোনো প্রোগ্রামসংক্রান্ত আমাদের সমষ্টিগত দায় সেই প্রোগ্রামের জন্য আপনার থেকে আমাদের প্রকৃতপক্ষে প্রাপ্ত মোট ফি-তে সীমিত থাকবে।
(গ) বাংলাদেশের আইন অনুযায়ী যে দায় অব্যাহতি বা সীমিত করা যায় না — যেমন আমাদের অবহেলাজনিত মৃত্যু বা শারীরিক আঘাত, অথবা প্রতারণা — এই শর্তাবলির কোনো অংশ তা সীমিত করে না।
১০, ১১, ১৪ বা ১৬ নং ধারা লঙ্ঘন অথবা আপনার কোনো বেআইনি কাজ বা অবহেলার কারণে আমাদের কোনো ক্ষতি, ব্যয় বা তৃতীয় পক্ষের দাবি মোকাবিলা করতে হলে আপনি তার ক্ষতিপূরণ দিতে সম্মত হচ্ছেন।
আমরা আপনার ব্যক্তিগত উপাত্ত আমাদের গোপনীয়তা নীতি অনুযায়ী পরিচালনা করি; নীতিটি এই শর্তাবলির অংশ এবং ব্যক্তিগত উপাত্ত সুরক্ষা আইন, ২০২৬ (২০২৬ সনের ৬৩ নং আইন)-এর সঙ্গে সঙ্গতিপূর্ণ। আমাদের কাছে ব্যক্তিগত উপাত্ত দেওয়ার আগে অনুগ্রহ করে নীতিটি পড়ুন।
(ক) আমরা সময়ে সময়ে এই শর্তাবলি সংশোধন করতে পারি। হালনাগাদ সংস্করণ কার্যকর তারিখসহ ওয়েবসাইটে প্রকাশ করা হবে এবং সেই তারিখ থেকে প্রযোজ্য হবে।
(খ) কোনো পরিবর্তন গুরুত্বপূর্ণ হলে এবং বর্তমানে ভর্তি প্রশিক্ষণার্থীদের প্রভাবিত করলে সংরক্ষিত যোগাযোগের ঠিকানায় নোটিশ দেওয়া হবে।
(গ) কার্যকর তারিখের পরেও আপনার ব্যবহার অব্যাহত থাকলে সংশোধিত শর্তাবলি গৃহীত বলে গণ্য হবে। সংশোধনের ফলে এখনই ভর্তি কোনো প্রোগ্রামের পূর্বসম্মত ফি স্বয়ংক্রিয়ভাবে পরিবর্তিত হবে না।
(ক) এই শর্তাবলি এবং ইহাসংক্রান্ত যেকোনো বিরোধ গণপ্রজাতন্ত্রী বাংলাদেশের আইন দ্বারা নিয়ন্ত্রিত হবে।
(খ) বিরোধের লিখিত নোটিশের তারিখ হতে তিরিশ (৩০) দিনের মধ্যে উভয় পক্ষ সদিচ্ছার সঙ্গে আলোচনার মাধ্যমে নিষ্পত্তির চেষ্টা করবে।
(গ) নিষ্পত্তি না হলে বাংলাদেশের ঢাকার আদালতসমূহের একচ্ছত্র এখতিয়ার থাকবে।
(ক) এই শর্তাবলি ইংরেজি ও বাংলা — উভয় ভাষায় প্রকাশিত। দুইটি সংস্করণই সরকারি পাঠ এবং সমানভাবে বাধ্যকর; উভয় সংস্করণে ধারার ক্রমিক নম্বর অভিন্ন।
(খ) সংস্করণ দুটিকে একক দলিল হিসাবে একসাথে পাঠ করতে হবে এবং যতদূর সম্ভব পরস্পরসঙ্গতিপূর্ণভাবে ব্যাখ্যা করতে হবে।
(গ) এরূপ ব্যাখ্যার পরেও দুই পাঠের বিরোধ নিরসন না হলে, সেই অর্থ প্রাধান্য পাবে যা দলিলের সামগ্রিক পরিপ্রেক্ষিত ও সংশ্লিষ্ট ধারার উদ্দেশ্য বিবেচনায় পক্ষদ্বয়ের অভিন্ন অভিপ্রায়কে সর্বোত্তমভাবে প্রতিফলিত করে এবং বাংলাদেশের বাধ্যতামূলক আইনের সঙ্গে সঙ্গতিপূর্ণ।
(ঘ) অনুবাদ হওয়ার কারণে কোনো সংস্করণকে অপরটির অধীন বলে গণ্য করা যাবে না অথবা কোনো পক্ষের বিরুদ্ধে ব্যাখ্যা করা যাবে না।
(ক) এই শর্তাবলির কোনো বিধান অবৈধ বা অপ্রযোজ্য বিবেচিত হলে অবশিষ্ট বিধানসমূহ পূর্ণ বলবৎ থাকবে এবং অবৈধ বিধানটি তার উদ্দেশ্যের সবচেয়ে কাছাকাছি একটি বৈধ বিধান দ্বারা প্রতিস্থাপিত হবে।
(খ) কোনো বিধান প্রয়োগে আমাদের বিলম্ব বা ব্যর্থতা সেই বিধান পরিত্যাগ বলে গণ্য হবে না।
(গ) আপনি এই শর্তাবলির অধীন অধিকার হস্তান্তর করতে পারবেন না। আমরা ব্যবসার উত্তরাধিকারী বা গ্রুপভুক্ত কোম্পানির নিকট আমাদের অধিকার হস্তান্তর করতে পারি।
(ঘ) এই শর্তাবলি, গোপনীয়তা নীতি এবং আপনার ভর্তি নিশ্চিতকরণ মিলে এ সংক্রান্ত সম্পূর্ণ চুক্তি গঠিত হয় এবং পূর্ববর্তী যেকোনো আলোচনা বা বক্তব্য অকার্যকর হয়।
(ঙ) শিরোনামগুলি কেবল সুবিধার জন্য; এগুলি ব্যাখ্যায় প্রভাব ফেলবে না।
